The 1-hectare rule
The Agricultural Land Act (Article 83) provides that agricultural land outside the boundaries of the construction zone cannot be divided into cadastral parcels smaller than 1 ha (10,000 m²). A survey report that would create smaller parcels cannot be certified by the cadastre.
Two statutory exceptions
- Division based on inheritance — probate division may create smaller parcels.
- Division for the construction of infrastructure — roads, utility lines and similar works defined by spatial planning regulations.
How the procedure works
The subdivision report is accompanied by a certificate that the parcel lies outside the construction zone. If a parcel is partly within the construction zone, different rules apply to different parts — which is exactly why we check the spatial plan and records free of charge before any order, so the report never ends up unimplementable.
